Child maintenance guarantee fund: monthly advances capped at €300
Royal Decree-law 31/2026, published on 21 October, reforms Spain’s Child Maintenance Payment Guarantee Fund. It raises the maximum public advance to €300 per beneficiary per month where court-ordered child maintenance remains unpaid.
This caps the public advance; it neither changes the court-ordered payment nor guarantees €300 to every family. Eligibility conditions, including financial requirements, still apply. The reform links the income threshold to Spain’s minimum wage.
When it applies
The amendment entered into force on 21 October 2026. Advances active on that date will be reviewed automatically, without a new application, with financial effects from 1 November. Earlier applications awaiting a decision will use the new maximum.
What to check
Review the maintenance order, evidence of non-payment and the Fund’s eligibility conditions. An advance does not cancel the debt or replace possible enforcement of the order against the person required to pay.
