Adult children

Agreement to pay for the studies of a financially independent daughter

The financial independence of a child does not prevent their parents from wanting to continue helping them with specific training. This breakup agreement provided for sharing certain academic expenses of a daughter who was already working, through contributions to an account designated for that purpose.

Aid was defined by its purpose

The text described children of legal age and the absence of safety measures custody. However, the parents wanted to maintain a specific educational contribution, differentiated from a spousal maintenance between them.

The particularity of the case was to separate the voluntarily agreed aid from the assertion that there was, due to that fact alone, a general obligation to pay for any study for any adult child. To know the scope of an obligation, it is necessary to examine its foundation and the specific wording of the agreement.

An account does not replace a complete clause

The proposal used contributions from both to a joint account. An agreement of this type should identify the studies, the expenses included and what payments can be made from it.

It is also important to foresee duration, supporting documents, remaining balance and changes in enrollment or program. If the commitment is described only with a monthly figure and a generic reference to the university, doubts may arise when the course ends, the training is interrupted or its cost changes.

How to formalize aid clearly

It is useful to gather registration, academic calendar and budget, along with the text of the commitment and the rules of operation of the account. It should be clarified who can order payments and what happens if a contribution does not arrive on time.

The source document used separation denominations and divorce that must be harmonized before formalizing a breakup. Furthermore, it is advisable to assess how the adult recipient of the aid intervenes and the effectiveness of the pact. The article does not attribute to the agreement an approval that is not recorded: it explains how to prevent a desire for support from ending in a conflict over its extension.
