Financial need does not determine allocation of liquidation lots

Supreme Court · Civil Chamber · STS 58/2026 · Appeal 68/2024
· Note published and reviewed: 2026-10-27

The issue and the court’s approach

Housing need could justify temporary occupation, but not preferential entitlement to the more convenient lot at liquidation. Statutory allocation rules applied, and common partitioner fees were not procedural costs.
