maintenance and expenses

Common account of the children and discussion about the destination of the funds

In one shared custody A dispute may arise over what can be paid with contributions for children. The document examined discussed whether the resolution had created an account limited to school receipts or a pension intended to meet the broader needs of a minor.

The interpretation of the title was the center of the conflict

The party making allegations maintained that the amounts constituted maintenance and not a fund reserved solely for school and activities. He argued that the amounts had been used for maintenance, clothing, transportation and household needs linked to the daughter.

The controversy shows that the expression "common account» does not explain the economic regime by itself. You have to read the ruling and the agreement, if it exists, to identify the purpose, the contributions, the way of administration and the limitations that were actually established.

What should be documented

Before a prosecution of improper use, it is advisable to reconstruct movements, concepts and justifications. A payment from the account does not in itself prove that it is unrelated to the minor, but a generic explanation does not allow proof of all charges either.

The brief alleged an important difference of resources between parents and difficulties in maintaining daily needs during one of the shifts. These circumstances provided context to the defence, although they did not replace verification of the movements discussed.

How to prevent new disagreements

Clear regulation can specify what expenses are charged, how they are justified, who keeps the receipts, and what information is provided. You should also distinguish alimony funds from other bills or debts among adults.

If the conflict includes a claim for supposedly pending contributions, the proof of income must be reviewed separately from the subsequent destination of the money. Mixing both debates makes it more difficult to clarify what was breached. The practical analysis begins with the current title and the specific movements; not by assuming that shared custody requires paying all expenses only in halves.
