When to review custody or maintenance orders in Spain
What changes to document before seeking a review of custody, contact or maintenance arrangements and how to prepare for advice.
Start with the current order
Gather the complete judgment or order and any approved agreement. Identify the provision you want reviewed and the specific present difficulty. Distinguish a temporary problem from a lasting change. Tell the office when booking if you do not have the full order.
Compare the earlier and current situations
Prepare a simple comparison of the circumstances when the order was made and today: working hours, residence, children’s needs and income, as relevant. Add dates and records supporting each change. Explaining that the arrangement is no longer convenient is not enough for an informed assessment.
Do not change arrangements unilaterally
Article 775 of the Civil Procedure Act provides for reviewing final family orders where circumstances have changed substantially. Assessment depends on the particular order and facts. Do not assume maintenance is suspended or replace residence arrangements on your own while preparing a request.
Questions before choosing the next step
Ask which facts matter, what evidence is missing and whether agreement or a court application is appropriate. Mention urgency or risk to a child at first contact. Bring a realistic proposal and alternatives; a consultation cannot promise an outcome or decision date.
